What if I want to leave someone out of my Will?

This article gives some initial guidance and food for thought for those circumstances where you want to leave someone out of your Will.

First of all, it is important to highlight that it is entirely up to you as to who you benefit, financially and/ or otherwise in your Will. There are no strict requirements which set out who you should and should not make provision for in the event of your death.

However, what must be considered is the reasonableness of what you wish to do and whether there is the potential for a claim to then be made against your estate by a person/ people who have either been left out completely or feel they should have received more.

When you complete your online Will interview, you will be asked if you are intending on leaving anyone out of your Will that may expect to inherit. If the answer is yes, we will discuss that further with you at your Legal Appointment. It is likely we will need a little information from you concerning your reasons for doing so and why that person may expect to inherit.

We may then refer you for a further specific free additional appointment with our in house Solicitor to consider this further. That is not to persuade you to make provision where you do not wish to do so, that is to ensure we can still proceed with your Will, doing everything possible to ensure the Will cannot be contested (challenged) by that person.

This may involve inserting a very brief non provision clause in your Will; but where this is relevant our Solicitor will also discuss with you the potential merits of any claim of any person being left out (not being provided for in the way they expect).
